SoMo Trailer Rentals
Reservation and Rental Terms & Conditions
Effective Date: September 17, 2026
Please read these Reservation and Rental Terms & Conditions (“Terms”) carefully. By making a reservation, signing a rental agreement, taking possession of a trailer, or allowing another person to tow a trailer rented in your name, you (“Customer,” “you,” or “your”) agree to these Terms.
These Terms apply to trailers and related accessories rented from SoMo Trailer Rentals (“SoMo,” “Company,” “we,” “us,” or “our”).
1. Definitions
Authorized Driver means a person approved by SoMo to tow the Trailer who is at least 21 years old, has a valid government-issued driver’s license, meets SoMo’s identification and payment requirements, and is listed on the Rental Agreement.
Customer means the person or business making the reservation, signing the Rental Agreement, paying for the rental, or accepting possession of the Trailer.
Equipment means the Trailer and all items provided with it, including but not limited to ramps, gates, spare tire, jack, locks, straps, chains, coupler, breakaway equipment, keys, GPS device, loading accessories, and other listed equipment.
Rental Agreement means the individual agreement, reservation confirmation, inspection form, checkout form, invoice, electronic record, or other document identifying the Equipment, rental period, rates, charges, and Customer.
Trailer means the specific utility trailer, enclosed cargo trailer, equipment trailer, car hauler, dump trailer, or other towable unit identified in the Rental Agreement.
Tow Vehicle means the motor vehicle approved by SoMo and used to tow the Trailer.
Rental Period means the period beginning when Customer or an Authorized Driver takes possession of the Trailer and ending when SoMo accepts the Trailer’s return and completes its check-in inspection.
2. Reservation Requirements
Customer must be at least 21 years old and must provide accurate identification, contact, payment, and Tow Vehicle information.
Pickup and return are 6:00 AM through 12:00 AM (midnight) America/Chicago. A rental day ends at midnight (24:00), not at 12:00 AM the morning of that day.
SoMo may require: a valid government-issued photo ID; a valid driver’s license for each Authorized Driver; a current address, telephone number, and email address; a major credit card or approved debit card in Customer’s name; proof of auto insurance or other information requested by SoMo; verification of the Tow Vehicle, hitch, electrical connector, towing capacity, and brake-controller setup; a refundable deposit or payment-card preauthorization.
SoMo may cancel a reservation or refuse to release Equipment if Customer provides incomplete, inaccurate, fraudulent, unverifiable, or inconsistent information; fails to meet safety requirements; cannot provide an appropriate Tow Vehicle; appears impaired; or does not comply with these Terms.
A reservation is not a guarantee that a particular Trailer will be available unless SoMo confirms the reservation in writing.
3. Reservation Changes and Cancellations
Customer may request a reservation change or cancellation by contacting SoMo at hello@somotrailerrentals.com or through the booking site.
Cancellation / no-show policy (as enforced by the booking system):
- Cancel 24 hours or more before pickup: full refund of the rental charge; damage hold released.
- Cancel less than 24 hours before pickup: 50% of the rental is kept as a cancellation fee; hold released.
- No-show: 100% of the rental is kept; hold released unless a dispute is on file.
- Failure to appear within a reasonable window of the scheduled pickup without notice may be treated as a no-show and SoMo may release the Trailer to another customer.
Rates may change if Customer changes Trailer type, pickup time, return time, location, rental duration, accessories, delivery service, or other reservation details.
SoMo may substitute a comparable Trailer if the reserved Trailer is unavailable due to safety concerns, damage, prior customer delay, maintenance, theft, weather, or another circumstance outside SoMo’s reasonable control.
4. Rental Charges and Payment
Customer is responsible for all rental charges, taxes, deposits, fees, damage charges, recovery expenses, collection costs, and other amounts authorized by the Rental Agreement and these Terms.
Daily rates are set per trailer and shown at checkout. Seven through 29 consecutive days are 10% off that daily rate (a 4 × 8 week is $189; a 6 × 12 week is $252). Thirty or more consecutive days are 15% off (30 days is $765 on the 4 × 8 and $1,020 on the 6 × 12). The discount applies to the rental before tax. The $100 security hold is unchanged.
Customer authorizes SoMo to charge the payment card provided for: rental charges and extensions; applicable taxes; security-deposit or preauthorization amounts; late-return fees; cleaning fees; missing-equipment fees; damage, tire, wheel, brake, coupler, ramp, gate, lock, jack, wiring, or accessory charges; towing, recovery, storage, transport, or repossession expenses; replenishment charges if applicable; repair estimates or invoices; administrative charges stated in the Rental Agreement; legally recoverable lost-rental-income charges resulting from Customer-caused damage or delayed return; returned-payment, chargeback, collection, court, and attorney fees to the extent permitted by law.
All estimated charges are due before the Trailer is released unless SoMo agrees otherwise in writing.
5. Deposits and Card Preauthorizations
SoMo requires a $100 refundable security hold (card preauthorization) unless otherwise stated at checkout. The hold is not a limit on Customer’s financial responsibility.
SoMo may deduct documented, authorized charges from the hold or charge the payment card for amounts due. SoMo will provide an itemized statement of applicable deductions when required or reasonably requested.
Any unused hold balance will be released within 3 business days after the Trailer is returned, inspected, and all known charges are determined (bank processing times may delay availability after SoMo releases the hold).
6. Authorized Drivers
Only Customer and Authorized Drivers approved by SoMo may tow the Trailer. Customer is responsible for the acts, omissions, negligence, and violations of every person who uses, possesses, operates, loads, unloads, moves, stores, or controls the Trailer during the Rental Period. Customer shall not permit an unapproved person to tow, move, possess, or use the Trailer.
7. Tow Vehicle and Hitch Requirements
Customer represents that the Tow Vehicle is mechanically sound, properly insured, legally registered, and capable of safely towing the Trailer and its cargo.
Customer is responsible for ensuring that the Tow Vehicle has: adequate manufacturer-rated towing capacity; adequate payload and tongue-weight capacity; a properly rated hitch receiver, ball mount, hitch ball, and safety-chain connection; the correct hitch-ball size for the Trailer; a functioning electrical connection for Trailer lights; functioning brake lights, turn signals, and running lights; a properly functioning trailer-brake controller when required; tires, brakes, suspension, mirrors, and other safety components suitable for the intended load; a valid license plate, registration, and insurance.
SoMo may inspect the Tow Vehicle, hitch, lights, brake controller, and connection before releasing the Trailer and may refuse to rent if the setup is unsafe or unsuitable. Customer is responsible for all information provided about the Tow Vehicle, hitch, cargo, travel route, destination, and intended use.
Typical hitch for these utility trailers: 2" ball. The 4 × 8 is ~2,000 lb GVWR; confirm capacity for the trailer you reserve. Customer must confirm their vehicle’s tow rating.
8. Customer Inspection and Acceptance
Before leaving SoMo’s premises (or completing contactless pickup), Customer and any Authorized Driver shall inspect the Trailer and all Equipment and notify SoMo before departure of any visible damage, defect, missing item, tire issue, light issue, brake issue, coupler issue, or other concern.
Customer’s signature, electronic acceptance, possession of the Trailer, or departure constitutes acknowledgment that the Trailer was inspected and accepted in the documented condition, except for defects recorded on the checkout inspection form.
Customer shall inspect the Trailer periodically during the Rental Period and shall immediately stop using it and notify SoMo if any unsafe condition occurs.
9. Customer Responsibilities
Customer and every Authorized Driver shall: use the Trailer only for lawful purposes; operate safely and in compliance with all laws; follow manufacturer instructions, safety labels, and SoMo instructions; secure the Trailer to the Tow Vehicle correctly; use appropriate cargo securement; keep cargo within stated payload/axle/tire/load limits; maintain safe load distribution and proper tongue weight; keep the Trailer locked and reasonably secured when unattended; use the Trailer only within approved geographic areas; report accidents, theft, loss, damage, detention by law enforcement, mechanical problems, or other incidents to SoMo immediately; notify law enforcement promptly if the Trailer is stolen or involved in a collision; cooperate with SoMo, its insurer, law enforcement, recovery personnel, and repair providers; return the Trailer clean and with all accessories; return at the agreed time and approved location in Theodore, AL (the exact address and directions are sent after booking, unless otherwise agreed).
10. Prohibited Uses
Customer and any Authorized Driver shall not: allow anyone not approved by SoMo to tow or use the Trailer; operate while under the influence of alcohol, marijuana, illegal drugs, impairing medication, or any impairing substance; use the Trailer recklessly, unsafely, illegally, abusively, or intentionally harmfully; overload the Trailer or exceed stated limits; use with an inadequate/unsafe/damaged Tow Vehicle; operate without required brakes, brake controller, lights, safety chains, breakaway equipment, or proper hitch where required; transport passengers, animals, human remains, or any person inside the Trailer; transport illegal drugs, hazardous waste, explosives, flammables, firearms, toxic materials, improperly sealed liquids, stolen property, or prohibited/unlawful cargo; use for racing, off-road use, demolition, stunts, towing another trailer unless approved, or competitive events; use beyond rated capacity; sublease, assign, sell, pledge, abandon, conceal, modify, dismantle, or alter the Trailer; remove, disable, cover, tamper with, or interfere with a GPS device, lock, identification number, safety decal, or other Company equipment; take the Trailer outside the United States without prior written approval; take the Trailer outside the approved rental area or across state lines if prohibited by the Rental Agreement; use for commercial hauling / transportation for hire unless SoMo gives written approval; store or use as a residence, sleeping area, dwelling, gathering place, or shelter; use after discovering an unsafe condition or mechanical defect.
Violation is a material breach and may result in immediate termination, recovery, denial of optional protection, additional charges, and legal action.
11. Cargo and Load Security
Customer is solely responsible for selecting, loading, distributing, securing, transporting, unloading, and protecting Cargo. SoMo does not load Customer’s Cargo unless expressly agreed in writing. SoMo is not a bailee of Customer’s Cargo and does not accept custody, care, possession, responsibility, or liability for Cargo.
12. Accidents, Damage, Theft, and Loss
Customer shall immediately notify SoMo of any collision, accident, theft, damage, loss, mechanical issue, law-enforcement stop, impoundment, seizure, or claim involving the Trailer; call emergency services when appropriate; obtain a police report when required or requested; obtain names, contact details, insurance information, and photographs; take reasonable steps to protect the Trailer from further damage; not admit liability or settle on SoMo’s behalf; cooperate fully with SoMo and its insurer.
Customer is responsible for loss of or damage to the Trailer and Equipment during the Rental Period, subject to any applicable written damage-waiver terms or insurance coverage. Customer may be responsible for repair/replacement cost, towing, storage, recovery, administrative costs, loss of rental use where permitted, diminished value where permitted, and other documented losses.
13. Insurance and Optional Protection
Customer is responsible for determining whether personal auto, commercial, credit-card, or other insurance covers a rented Trailer, damage, liability, Cargo, towing, roadside assistance, theft, or loss of use. Personal insurance may not cover rented trailers or related losses.
Any optional protection product or damage waiver offered by SoMo is governed by separate written terms and is not insurance unless expressly identified as such. No optional protection applies if Customer or an Authorized Driver violates the Rental Agreement, provides false information, allows an unauthorized driver, operates while impaired, uses the Trailer unlawfully, overloads it, leaves the approved geographic area without permission, or engages in prohibited use.
14. Return of Trailer
Customer shall return the Trailer and all Equipment at the agreed return time and location in Theodore, AL (the exact address and directions are sent after booking, unless otherwise agreed), in the same condition as received (ordinary wear and tear excepted), reasonably clean, with all accessories, without unauthorized modifications.
Late return: 30-minute grace, then $20 per hour or fraction, charged to the card on file, capped at $40 per day overdue.
The Trailer remains in Customer’s care until SoMo physically receives it, inspects it, and checks it in. Failure to return as agreed may result in recovery action, reporting to law enforcement, collection activity, and civil or criminal remedies as allowed by law.
15. Recovery, Towing, and Storage
If Customer fails to return the Trailer as agreed, abandons it, leaves it unsecured or at an unauthorized location, breaches the Rental Agreement, or otherwise causes SoMo to recover the Trailer, Customer authorizes SoMo to take reasonable lawful steps to locate, recover, tow, transport, secure, repair, and store the Trailer, and is responsible for documented legally recoverable costs (retrieval, towing, storage, locksmith, GPS/tracking recovery expenses, disclosed administrative charges, repairs/replacement, unpaid rental and late fees, and other documented costs caused by breach or failure to return).
If Customer leaves Cargo in a recovered or returned Trailer, Customer must arrange removal within 7 days after notice from SoMo. Cargo not timely removed may be handled as permitted by law; Customer remains responsible for legally recoverable storage, handling, and disposal costs.
16. Customer Indemnification
To the extent permitted by Alabama law, Customer agrees to defend, indemnify, and hold harmless SoMo Trailer Rentals, its owners, employees, agents, affiliates, and representatives from claims, liabilities, damages, penalties, costs, and expenses arising from Customer’s or an Authorized Driver’s use/possession/loading/unloading/towing/storage/return of the Trailer; breach of the Rental Agreement or these Terms; Cargo; violation of law; or injury, death, or property damage caused by Customer, an Authorized Driver, passenger, helper, employee, contractor, or other person acting with Customer’s permission. This section does not eliminate liability that cannot legally be waived or shifted under applicable law.
17. Limitation of Company Liability
To the fullest extent permitted by law, SoMo is not responsible for indirect, incidental, special, consequential, punitive, or lost-profit damages arising from reservation changes, Trailer availability, rental delays, mechanical issues, Cargo loss, Customer travel interruption, missed appointments, business interruption, or other rental-related events. Nothing in these Terms waives liability that cannot lawfully be waived.
18. Communications and Electronic Consent
Customer authorizes SoMo to contact Customer regarding the reservation, rental, payment, deposit, damage, return, recovery, collections, safety notices, and other transaction-related matters using the phone, text, email, or mailing address provided. Message and data rates may apply. Customer agrees that electronic signatures, electronic records, electronic inspection forms, texts, emails, photographs, and electronic payment records may be used and may have the same effect as paper records and handwritten signatures to the extent allowed by law.
19. Privacy and GPS Tracking
SoMo may collect and use Customer identification, driver’s-license information, payment information, reservation details, Tow Vehicle information, photographs, inspection records, and communications for reservation processing, fraud prevention, insurance, safety, payment collection, recovery, customer service, and legal compliance.
Trailers may be equipped with GPS or other tracking technology. By renting a Trailer, Customer consents to SoMo’s use of tracking technology for fleet management, theft prevention, recovery, safety, maintenance, payment enforcement, and verification of compliance with the Rental Agreement.
SoMo will handle personal information in accordance with its Privacy Policy on somotrailerrentals.com (Privacy / FAQ pages as published).
20. Default and Material Breach
Material breaches include: providing false/misleading/incomplete/fraudulent information; allowing an unauthorized driver; operating while impaired or unlawfully; overloading or misusing the Trailer; failing to return as agreed; tampering with GPS, locks, IDs, or Company property; transporting prohibited Cargo; leaving the approved area without permission; failing to pay amounts due; any prohibited use.
Upon material breach, SoMo may cancel the reservation, terminate the rental, refuse future rentals, charge amounts due, recover the Trailer, contact law enforcement where appropriate, file an insurance claim, and pursue other remedies available under law.
21. Governing Law and Venue
These Terms and the Rental Agreement are governed by the laws of the State of Alabama, without regard to conflict-of-law principles. Any dispute arising from the reservation or rental shall be brought in a court of competent jurisdiction in Mobile County, Alabama, unless the parties agree otherwise in writing or applicable law requires a different venue.
22. No Waiver
SoMo’s failure to enforce any provision of these Terms does not waive its right to enforce that provision later or enforce any other provision.
23. Severability
If a court finds any portion of these Terms invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
24. Entire Agreement
The Rental Agreement, these Terms, the inspection forms, any selected optional-protection terms, payment authorization, and any written addenda form the entire agreement between Customer and SoMo concerning the reservation and rental. No oral statement changes these Terms. Any modification must be in writing and signed by an authorized representative of SoMo.
